Notable Cases

Daisy advised on the complexities of obtaining possession of a property whilst the tenant is in a ‘mental health breathing space’ which can continue indefinitely. At Court, the team was successful in ensuring compliance with the terms of the breathing space and gaining possession of the Property.

Daisy worked on a complex ASB matter in which the team applied for a breach of injunction against a tenant by way of committal proceedings. These proceedings involve the ‘grey area’ between criminal and civil law and had to be handled with caution. At court the team was successful in obtaining the committal order. This ensured the team was able to seek possession of the property based on mandatory grounds.

Daisy advised on a disrepair matter which was discontinued by the other side upon a successful review of the repairs records and after highlighting the importance of giving the landlord notice of the repairs and without this, the claim fails.

Daisy recently advised on a complex fraud matter where a tenant was subletting the property on AirBnB. At Court, the team was successful in obtaining possession of the Property and are currently instructed on further enforcement proceedings.

Daisy was instructed on a Section 20 dispensation matter. This is a complex matter in which she aims to ensure that the client complies with their duty to consult residents on decisions that affect their tenancy whilst the client’s objectives are also protected.
