Restrictive Covenants and their commercial implications

Restrictive Covenants are commonly used to protect an employer’s business interests. They are clauses contained within contracts of employment, but also are often included within commercial contracts as well. However, to ensure that restrictive covenants are found to be enforceable, there are key commercial and legal issues to consider, because at common law, a restrictive covenant is potentially void as a restraint of trade.

In this webinar we will look at ensuring restrictive covenants are proportionate and reasonably necessary to protect the legitimate business interests of the employer. We will look at what the courts take into account when considering whether a restrictive covenant is enforceable or not, and finally, we will look at the steps employers can take to enforce restrictive covenants.
