Back to Basics: Payment in Construction Contracts

This session will review the minimum requirements for payments mechanisms within construction contracts, as set out with the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts.

 

It will also explore the recent developments in case law regarding construction payment mechanisms (set out below) and provide pragmatic advice on payments under construction contracts including:

 

  • Feasibility of linking payment to receipt of VAT invoices;
  • The substance, form, intent and contractual context of required notices;
  • Validity of issuing 2+ payment notices in any single payment cycle;
  • Recovery and overpayments; and
  • Reaffirmed importance of maintaining cash flow and the serious consequences for failure to pay.
